Eminent Domain in SCV

March 19, 2006 |

Newhall, California; The City of Santa Clarita may use the power of eminent domain to develop three sites in downtown Newhall if officals aren’t satisfied with the current property owners plans for their land.

At issue are 32 parcels owned by 18 property owners whose main objective is to build “High Profile” sites for the area, while the city has palns for 2 parking structures and a civic building on the site.  {I can understand the civic building … but 2 parking structures, 4 stories high?}

Quoting Joseph Jansik from the German Autohaus Auto Repair shop who states he will close up shop rather than relocate if the city moves forward, “In a prime real estate market putting the parking structures doesn’t make sense from an economic standpoint. I don’t want to go to war until I have an enemy. I’m waiting to see what happens”

This area of town has been tagged for revitalization by the city. Chris Price, city of Santa Clarita project manager for redevelopment, is quoted as saying “We would use eminent domain to assemble properties if people don’t want to sell, but that would be the last resort”

Eminent Domain is governments power to take private property for a public use. If the city decides to “assemble” properties for a project and invokes eminent domain the propert owners would be paid and relocated.
